Buyer agrees to breed only to the Breed: Biewer a'la Pom Pon

Buyer understand this puppy/dog under any circumstances will not be bred to any other breed other than Biewer to Biewer. Nor will the dog be studded out for services to any other breed other than another Biewer.

If a litter is produced by accident to a different breed other than the Biewer, the litter must be spayed or neutered. Buyer agrees to that if you would produce a Biewer litter these puppies will not be sold to pet Stores, Puppy Mills and/or Puppy Brokers.

This puppy, to the best knowledge of the seller, is in good health at the time of sale. It will be up to date on vaccinations and worming, will have been examined by a veterinarian and given a clean bill of health. Puppy will have a liver enzyme blood panel or a bile acid test done.

Buyer must provide proper care for the puppy, including nutrition, vet care and immunizations. Failure to do so will void this Health guarantee.

In order to activate the warranty, the buyer shall take the puppy to a veterinarian within 48 hours for a wellness exam. This vet exam is mandatory to ensure that your puppy is healthy upon delivery.

A copy of this guarantee, signed by the buyer and accompanied by an invoice from the buyer's licensed veterinarian, must be sent back to the seller, and postmarked before the 7th day of new ownership. If the seller does not receive above mentioned criteria, this contract is null and void.

Until the puppy reaches one year of age, the breeder will warranty the puppy for life threatening congenital or hereditary defect. If puppy is found to have a life threatening congenital or hereditary defect (excluding tracheal collapse, and patella luxation, since both may involve trauma or environmental issues), meaning that the puppy would die from the genetic defect, within the first year of its life it will then be replaced with exchanging the puppy for another. No one may keep the original puppy to be exchanged. The original puppy must be returned to the breeder (at the new owner's expense). Puppy must be returned before new puppy can be picked up; guarantee is on a replacement basis only. If no puppy is available at that time, buyer must wait until one becomes available. No refunds will be given at any time. In the event that your puppy dies from a genetic defect, an autopsy report stating the cause of death would be required within 5 business days of death, all medical and/or autopsy costs will be the responsibility of the buyer.

This guarantee does not include the following: Hernias, Testicle dissention, hypoglycemia, intestinal parasites, as parasites are a transmittable disease & retained teeth. The guarantee does not cover adverse reactions to vaccines, medications or any complications resulting from a surgery. No warranty will be given if the puppy is euthanized.

All sales are final. The seller/breeder is not responsible for any veterinarian fees incurred by this puppy and the new owner. I can only estimate at the puppy's adult weight. For that reason, no guarantee is made for the weight or size of the puppy when the puppy reaches maturity. There are no guarantees on color or the ability to breed or show.

If the buyer is unable to care for and take care of their new puppy for any reason, the breeder is to be given the notice of intent to sell or transfer the puppy and also have the first opportunity to buy back the puppy/dog and/or help the buyer find a new home for the puppy. If the puppy/dog was sold with breeding rights and said puppy is not to be re-homed, it will be to a pet home and neutered/spayed before re-homing.

This is an agreement between the buyer of the puppy and the Breeder/Seller of the puppy ONLY. This guarantee constitutes the complete guarantee between Gayle Jones (Breeder/Seller) and ___________________________________________ (buyer). On this date of _____________________, I have read, understand and agree to the terms of this guarantee.

It is mutually understood and agreed to that any litigation regarding this sale shall be brought in the County and State the Breeder/Seller resides in at the time.
